SB Co. Fixes District Appointments from August Election

SAN BERNARDINO – The Board of Supervisors on Tuesday adjusted a few appointment snafus to the Barstow Heights Community Services District regarding its August 2013 election, rescinding two county-appointed candidates to the CSD board.

The Board of Supervisors’ corrective action rescinded its appointments of Daryl Schendel as a full-term director and Jeanette Hayhurst as a short-term director to the CSD. After rescinding the two, the board then approved a resolution to appoint Hayhurst as a “full-term director” to the CSD.

A county staff report explained that Schendel’s recommendation by the district was invalid since he was already serving a four-year term that expires in 2015.

“Since Mr. Schendel already holds a seat in office, he is not eligible to be appointed to the office of Director-Full Term for the August 27, 2013 Consolidated Mail Ballot Election,” San Bernardino County Registrar of Voters Michael J. Scarpello reported in his staff report. “Therefore, it is recommended that his appointment be rescinded, leaving the seat vacant for further appointment.”

According to the minutes from the Barstow Heights CSD’s Sept. 23, 2013 meeting, when the board recommended Hayhurst and Schendel to the county for appointment to the board, Schendel abstained from the board’s recommendation to avoid a conflict of interest.

A May 23, 2013 election notice from the county’s Elections Office announced that three director seats were reported as open, including two full-term seats and one short-term seat on the CSD board. But apparently this was not accurate, according to Scarpello’s report.

“Additionally, the information provided in the certified notification on April 19, 2013, regarding the short term seat was inaccurate because the short term seat was not scheduled to go up for election,” Scarpello stated. “Since the seat was not vacant, it is recommended that the appointment of Ms. Hayhurst to the office of Director-Short Term be rescinded.”

However, county staff recommended the Board of Supervisors on Tuesday approve a resolution appointing Hayhurst to the full-term director seat on the CSD board.

The Board of Supervisors initially approved the appointments on Nov. 19, 2013 “in lieu of election to fill contest vacancies (office-holding contests) for various special districts in the August 27, 2013 Consolidated Mail Ballot Election, whereby these contests are under the jurisdiction of the Board of Supervisors,” the report states. “The action today rescinds two of those appointments and makes one replacement appointment.”

According to its Facebook page at facebook.com/pages, the CSD “improves and maintains two parks in the Barstow Heights neighborhood through a contract with the city of Barstow.”

The parks are Barstow Heights Park at Rimrock Road and H Street, and Venner Park at Panamint Road and K Street.
