Rumor That New York is Demanding Psychiatrists Turn Over Patient Records

With the defeat yesterday of S. 649, the so-called Senate gun compromise bill, 7 of the 9 gun-control bills before Congress are now kaput.

At the same time, despite the latest Gallup poll showing that only 4% of Americans think guns and gun control are an important problem facing the country, way behind other concerns about the economy, unemployment and the federal debt, the gun-control fanatics are feverishly at work at the state level across America.

The latest, according to AmmoLand blogger Dan Roberts, is that New York state officials are ordering psychiatrists to turn over their patient records, in violation of doctor-patient confidentiality.

Roberts claims that his sources say around April 12, 2013, two prominent and well-regarded psychiatrists in Buffalo, NY, had received subpoenas from state officials commanding them to turn over all of their patient files to the state.

Details are sketchy at this early stage,” but both psychiatrists have retained legal counsel and may be consulting with the law firm of Jim Tresmond. Tresmond is a specialist in firearms law and is the attorney of record for David Lewis, a resident of Amhurst, NY, whose lawfully purchased and owned firearms were confiscated by order of the NY State Police after what Lewis maintains was an illegal and unconstitutional review of his medical records.

It is unclear whether the subpoenas to the Buffalo area psychiatrists were issued by the State’s Attorney’s Office, NY State Police Superintendent Joseph D’Amico, or by the Office of the Commissioner of the NY State Division of Criminal Justice Services (DCJS).

At the same time on April 12, WBEN Talk Radio Show host Tom Baurele told listeners that he was told by multiple independent sources within the New York state government that after passage of the NY SAFE Act, a secret seven member “HIPAA” committee had been created within the Division of Criminal Justice Services (DCJS). The secret committee would work with the NY State Police at the behest of the Dept of Homeland Security to  obtain the private medical records of potentially millions of NY state residents. Those medical records will then be compared with the records of known firearms owners and pistol permit holders in order to facilitate the confiscation of firearms under the law’s vaguely-termed “mentally unstable“.

At this point, Dan Roberts’ assertion is hearsay that requires further substantiation and confirmation. But NaturalNews’ Mike Adams is trumpeting the information as fact, which is rather irresponsible.

That being said, gun owners in New York state should demand information and answers from their representatives in Albany.
