Vertical Axis Gets Hit With UDRP On ParkRoyal.com (Again) Now Based on 8 Year Old Trademark

The domain name ParkRoyal.com owned by Vertical Axis, Inc. has just been hit with a UDRP for the second time.

The complaint was filed by, Grupo Costamex, S.A. de C.V. (COSTAMEX) Operación y Supervisión de Hoteles, S.A. de C.V. (OPYSSA) who has a trademark on the term for Travel club services; travel agency services, filed in February 2005

There are several US Trademarks for this term, one filed on Alcoholic beverages, namely, whiskey Scotch whisky and Scotch whisky produced in Scotland.

As Attorney Zak Muscovitch points out  the small chain of hotels called the Park Royal Hotels who has a trademark on the Park Royal Hotels, owned by Pan Pacific Hotels Group, already lost a UDRP on its attempt to grab the domain name ParkRoyal.com in 2009.

The domain is parked with a very generic landing page.

The landing page has an “Buy It”/ Lease It Option

The domain has had a lot of ownership changes over the year, as it was owned by in 2003 by CES MARKETING GROUP, INC. of Vancouver, in 2006 the domain was under the ownership of DomainWorks Inc also of Vancouver.

In 2008-2009 the domain was under privacy but going to a hitfarm.com landing page

It will be interesting to see what happens to this domain.…
