All riders, including the pillion rider, who are older than four years must wear "protective gear" when operating a motorbike - Section 129(a) of Motor Vehicles Act
Such helmet shall be securely fastened to the head of the wearer by means of straps or other fastenings provided on the headgear.
No useful purpose in having the helmet on petrol tank or hanging elsewhere when you are on the motorcycle !!
