NFT collector sues OpenSea for locking his account after being scammed

The lawyer in charge of the legal team stated that this is not an isolated incident and that OpenSea occasionally ignores problems.

An NFT collector is suing the OpenSea NFT marketplace for a variety of reasons, including locking him out of his account for more than three months after falling victim to a phishing scam.

Robbie Acres is suing OpenSea for phishing his NFTs

Robbie Acres, an OpenSea user, told Cointelegraph that after his NFTs were stolen in a phishing scam, he immediately informed the NFT marketplace. However, the NFT collector claims to have had a lot of difficulty. Acres stated as follows: “They took over 48 hours to respond, by which time the stolen assets had been sold as the buyer significantly undervalued them in prioritizing pace over value.”

The NFT marketplace also intervened, locking his account to prevent him from causing further harm. However, Acres stated that this was not the answer he was looking for. “Opensea held my assets for ransom for more than three months, despite numerous requests to release them,” he said.

The NFT investor believes that the market should compensate for losses that occurred during the time period. Acres is certain that OpenSea’s actions cost him at least $500,000.

“Whether by intention or ineptitude, OpenSea’s actions caused me significant financial loss as I am an active investor in the web3 community,” he explained. Acres has since hired lawyers to take legal action against OpenSea.

Enrico Schaefer, the lawyer in charge of Acres’ case, stated that this is not an isolated case. The lawyer confirmed that multiple people are experiencing the same issue. Schaefer informed us:

“I have spoken with and represent several people who had their NFTs stolen or accounts compromised on the Opensea marketplace. In some instances, Opensea acknowledges its failures and makes the account owner whole. In others, OpenSea simply ignores the issue.”

Does OpenSea stop NFT scams?

When it was questioned about the Acres issue, an OpenSea representative stated:

“The theft in question took place outside of OpenSea and the items were sold before OpenSea became aware of the reported theft. Soon after we were notified and became aware, we disabled the items and the user’s account has since been unlocked.”

The platform also said that it has spent money on tools and people to help prevent and find theft and stop the reselling of stolen items on its platform. They put down: “Theft is one of the biggest and most challenging ecosystem issues to solve because it happens across many different digital surface areas and through many unique (and legitimate) communication channels.”

The NFT marketplace added a new stolen item policy on August 11 that makes police reports more useful. In response, some users took to Twitter to complain that OpenSea was unable to assist them after their NFT was stolen.
