An employer can only issue a work permit for foreign workers only when he will submit a favorable LMIA. LMIA allows a foreign employee to work for one employer at one employment position.  To get a favorable or positive LMIA, the employer must prove that he/she had already advertised the requirement in Canada and has undertaken extensive efforts to find domestic employees before making up their mind to hire foreign workers for the position. If there is no workforce available for the specific position, then the employer can get a positive LMIA and can hire foreign workers. LMIA is the pathway for many Canada PR from India.

Jobs that are exempt from LMIA

There are several jobs in Canada for which an employer can make an LMIA agreement. These jobs have been specifically exempted from the employer LMIA requirement. These jobs are:

  1. Jobs that are protected under international agreements.
  2. Jobs that are involved in large investments or other initiatives that fall under a deal between the federal government and a provincial or territory.
  3. Jobs that are exempted just because they significantly benefit Canada.
  4. Jobs that allow workers from countries with reciprocal advantages for Canadian citizens and permanent residents, charitable and religious work, or jobs that the Minister has designated as LMIA-exempt jobs.

LMIA-exempt work permits or open work permits 

No Canadian employer can appoint a foreign worker with an open work permit for the jobs which are exempted from the LMIA. He must have to get a positive LMIA first to issue an open work permit. However, an open work permit is only available for the applicants who fall under several categories, such as international students, participants in the Atlantic Immigration Program, students who are in need of financial assistance, spouses or partners of skilled workers or individuals with pending permanent residence.
