In the US Open, all
eyes were on Aussie tennis bad-boy Nick Kyrgios and Canadian sweetheart Eugenie
Bouchard as they grinned and flirted their way through the first round of the
US Open's mixed doubles draw. Fist-bumps, giggling furtive chats at the change
of ends and even playful towel fights were the order of the day as Kyrgios and
tennis partner Bouchard advanced in three sets at Flushing Meadows.
A negligence
lawsuit is a civil lawsuit that filed against a person or a legal party that
failed to use reasonable caution and caused damage to a victim while providing
care or services. It is essential to the
outcome of a negligence lawsuit for the victim to prove that harm was caused by
the standard of service she or he received.
Controversial
Australian Nick Kyrgios snapped "that's just crap!" at the umpire as
he earned his third code violation in a week when he smashed away a loose ball
and nearly hit a line judge. Kyrgios, 20, was left fuming by the decision at
the climax of the second set as he slumped from a dominant start to a 1-6, 6-4,
6-4 defeat by Kei Nishikori in the Shanghai Masters second round.
Eugenie
"Genie" Bouchard, is a
Canadian professional tennis player currently ranked world no. 38. At the 2014 Wimbledon Championships, Bouchard
became the first Canadian to reach the finals of a Grand Slam in singles,
finishing runner-up to Petra Kvitová. She also reached the semifinals of the
2014 Australian Open and 2014 French Open and won the 2012 Wimbledon girls'
title.
At the US Open, she
defeated Alison Riske and Polona Hercog, respectively, in the first and second
rounds, her first back-to-back wins since March at the BNP Paribas Open. She was scheduled to play Roberta Vinci in
the fourth round, but had to withdraw due to a concussion, an injury she
suffered after falling in the locker-room following her first-round match in
mixed doubles. That injury ended Nick Kyrgios' US Open adventure as she was
the mixed doubles partner and had to
withdraw.
Now comes the news
that Eugenie Bouchard is suing United States Tennis Association over US Open
locker room fall. In the lawsuit filed
on Wednesday in US District Court in Brooklyn,
she claims her fall was caused by
a "slippery, foreign and dangerous substance" on the floor. Bouchard
says she suffered a severe head injury, which caused her to withdraw from the
tournament. She also dropped out of a tournament in China.
Her suit claims the
USTA, tennis' national governing body, was negligent. It seeks unspecified
damages. The Canadian player, who was once ranked No. 5, contends her injuries
“were caused solely by the reason of carelessness, negligence, wanton and
willful disregard on the part of Defendant USTA.” She claims the organization
didn’t keep the locker room in a “safe and suitable condition” because the
organization failed to maintain, clean and repair the floor, which led to her
fall.
Bouchard said her
world ranking has dropped at least 13 spots since the incident last month and
believes it is likely to continue to decline. USTA spokesman Chris Widmaier
says the organisation does not comment on on-going litigation.
