Elon Musk, a prominent figure known for his innovations and controversies, recently withdrew his lawsuit against OpenAI CEO Sam Altman and Greg Brockman in a California state court on Tuesday. This decision marks the conclusion of a prolonged legal dispute between the co-founders of the artificial intelligence startup.
Musk, aged 52 and a billionaire, co-founded OpenAI in 2015. The lawsuit, initiated in February, alleged breach of commitment by the company. Initially established as a nonprofit with a mission to serve society, OpenAI shifted its approach by engaging private clients for proprietary gains, abandoning its original nonprofit intent.
In the legal filing, Musk asserted, “OpenAI, Inc.’s website still claims its mission is to ensure that AGI benefits all of humanity. However, in reality, it has evolved into a closed-source entity closely tied to Microsoft, focusing on refining AGI to maximize profits rather than benefiting humanity.”
Musk’s lawsuit demanded a jury trial and sought reimbursement of any profits accrued by OpenAI, Altman, and Brockman. In response, OpenAI dismissed Musk’s claims as baseless and advocated for the lawsuit’s dismissal. The company also published emails from Musk during his tenure at OpenAI, revealing his previous support for the organization’s financial goals, contradicting his allegations of profit-driven motives.

The decision to drop the lawsuit coincided with Musk publicly criticizing OpenAI for mishandling user data, prompted by Apple’s announcement of integrating ChatGPT with Siri on an opt-in basis.
