
The Court of Appeal decided yesterday (25) to grant permission to the respondents including the IGP to file objections to the writ petition filed challenging the second detention order obtained in the case of Nadun Chinthaka Wickramaratne aka ‘Harak Kata’, who is detained in the Criminal Investigation Department (CID) on detention orders.
This permission was given by the Court of Appeal President Justice Nissanka Bandula Karunaratne and Justice M.C.B.S. Moraes when this petition was called before the Appellate Court.
Accordingly, objections regarding the petition were ordered to be filed on or before October 9. The objections regarding those objections should be filed on or before October 26. The hearing of the petition was scheduled to begin on November 6.
Inspector of Police Public Complaints Unit S.H.S Thusitha Kahagalle, Inspector General of Police C.D. Wickramaratne and others are the respondents in this case.
The petitioner stated that he was arrested by the Security Forces in February in Madagascar while he was with ‘Kudu Salindu’ and six others. The petitioner stated that he was then brought to Sri Lanka and is being detained in the custody of the CID on detention orders. The detention order has been extended for the second time.
The petitioner requested the court to cancel these detention orders as his life has been threatened due to continuous detention orders.
The bench considered the facts regarding this petition and issued an interim restraining order preventing the transfer of the suspect from the CID where the petitioner is currently detained without the approval of the court.
On the advice of Advocate Thushari Jayawardena, Senior Advocate Senani Dayaratne and Advocates Nishadhi Wickramasinghe, Thiru Amirthalingam and Sanjay Ariyadasa appeared for the petitioner.
